Do I Really Need to Hire a Workers’ Compensation Lawyer?

In almost every case, hiring a work comp lawyer is key to getting fair compensation.

You’ve just hurt yourself at work; you think to yourself, “Should I even report my work-related injury to my employer? Do I really need workers’ compensation benefits?” The short answer is yes, you should report your injury, and file a work comp claim.

You should hire a workers’ compensation lawyer

You might have had a minor slip in your work area that has landed you in a physical therapist’s office though it’s not providing any relief. Or maybe your illness has persisted a bit too long. Or you’ve hurt your knee, and three months later you still haven’t had an MRI.  Hiring a work comp lawyer will be the best way to ensure you receive the best benefits from employer and insurer.  Like most insurance companies, your employer’s insurance company is only looking out for your employer.

 

Call an attorney if any of the following statements are true:

  • You’ve been off work because of your injury and are not receiving any income.
  • You are receiving inadequate medical care. You are not getting any better, you are not seeing a specialist, you are not getting diagnostic tests.
  • Your employer has retaliated against you after filing your claim. Examples include wrongful termination, demotion, reduced pay.
  • You have a workers’ comp hearing or other setting in front of a judge. REMEMBER, THE INSURANCE COMPANIES ALWAYS HAVE AN ATTORNEY ON THEIR SIDE!
  • Your employer denies your claim all together and is refusing treatment.
  • Your severe work-related injury requires surgery.
  • You receive or have applied for Social Security Disability Insurance or other benefits. Receiving workers’ compensation might decrease your SSDI benefits.
  • You have a pre-existing condition that might affect the same area on your body as your work-related injury. Insurance companies can attribute your work injury to your pre-existing condition.
